Action of the Center after the Supreme Court's comment: Cases registered under Section 66A of the IT Act will be withdrawn The law ended 7 years ago, the SC said - it is wonderful
The Central Government has ordered that all the cases registered under Section 66A of the IT Act will be withdrawn immediately. The Center has asked all the State Governments and the Chief of Police that the cases registered under this section should be withdrawn, as well as no further FIR should be lodged under it.
Center mentioned the objection of the Supreme Court in the order
The Center has said in a notice sent to the Chief Secretaries and DGPs of their states that some police officers are still registering cases under this section, while this section of the IT Act has already been abolished by the Supreme Court.
The Supreme Court has also expressed strong objection to this. You guys send instructions to all the police stations that no case should be registered under this section. If any such case has been registered, it should be withdrawn.
The Supreme Court had said – whatever is going on, it is terrible
The NGO People's Union for Civil Liberties (PUCL) had told the Supreme Court that under Section 66A of the IT Act, which you had abolished in 2015, more than 1 thousand cases have been registered in 7 years.
After the information received from PUCL, the bench of Justice R Nariman, Justice KM Joseph and Justice BR Gavai had said that this is a matter of surprise. We will issue notice. This is amazing. Whatever is going on is terrible.
The Supreme Court gave a historic decision in 2015
On 24 March 2015, the Supreme Court had abolished Section 66A of the IT Act, giving a historic verdict. The court had said that this law is blurred, unconstitutional and a violation of the right to freedom of speech. Under this section, the police had the right to arrest the user for posting offensive or derogatory content on the online platform.
