Narcotic Drugs and Psychotropic Substances (Amendment) Ordinance, 2021

"The Narcotic Drugs and Psychotropic Substances (Amendment) Ordinance, 2021 was promulgated on September 30. The Ordinance amends the 1985 NDPS Act to correct a drafting error. The 1985 Act regulates the manufacture, transport, and consumption of narcotic drugs and psychotropic substances."

The Narcotic Drugs and Psychotropic Substances (Amendment) Ordinance, 2021 was promulgated on 30th September 2021.

The Ordinance amends the Narcotic Drugs and Psychotropic Substances Act, 1985 to correct a draft error.

The Act regulates certain actions (such as the manufacture, transportation, and consumption) of narcotic drugs and psychotropic substances.

 

Punishment for financing or harboring persons engaged in illegal activities: Under the Act, financing or harboring persons engaged in certain illegal activities (such as the cultivation of cannabis, or manufacture of narcotic drugs) is an offense. Persons found guilty of this offense shall be punished with rigorous imprisonment of not less than ten years (for up to 20 years) and with a fine which shall not be less than one lakh rupees.

 

Drafting error: In 2014, the Act was amended and the clause number of the definition of such illegal activities was changed.

 However, the section on penalties for financing these illegal activities was not amended and continued to refer to the first section number of the definition. The Ordinance amends the section on penalties to change the context of the new section no. This amendment shall be deemed to have come into force with effect from 1st May 2014 (that is when the 2014 amendments came into force).
